Sacramento-Native Likely Key ‘Swing Vote’ in Prop. 8 Case

Sacramento-native, and Supreme Court Justice, Anthony Kennedy will likely be the “swing” vote in the Prop. 8 case, according to reports.

Professor John Sims at the University of the Pacific, McGeorge School of Law not only teaches constitutional law, but has had the opportunity to teach it alongside Justice Kennedy.

“Justice Kennedy has written the two leading opinions supporting equal protection for gays and lesbians…therefore, I wouldn’t consider him a total swing vote. But he hasn’t addressed marriage equality before,” Sims said Friday.

UOP not only boasts a connection to Justice Kennedy, but has graduates on both legal teams arguing before the nation’s highest court.
