In a jailhouse interview, Brandon Biagioni tells FOX40 he’s not guilty.
“I don’t think I have any fault in this,” Biagioni said. “He swung it at my head, yes.”
“Did it hit you,” we asked.
“No, I dodged it.”
It was an altercation. This man survived. An this man, 62-yera-old James Marlow did not.
“I’m allowed to be here, you know? He goes, ‘No you’re not.'”
Biagioni tells me he stayed in this Orangevale home from time to time with Diane Beath. But Beath was in the hospital, so she sent her friend Sandy Marlow to let her dog out.
“I called 911 to say there was an intruder,” Sandy said.
“He swung at my head, I kind of took it from him. It happened so quickly. It dinged him in the air a little bit,” Biagioni said.
“You didn’t swing the bat at him?” we asked.
But whatever happened next proved to take James’ life.
“It’s self-defense … I have no idea [what killed James],” Biagioni said.
The coroner’s office has reported James’ cause of death as undetermined. But they are not ruling out homicide.
“All he had to do was leave that house,” Sandy said.
Biagioni’s trial begins June 17.
