Modesto Police say a homeless man threatened to sexually assault a woman in her front yard Tuesday.

The woman had just returned home from work when 48-year-old Rusty Weston accosted her and asked if she had a lighter, police said. She told him she didn’t, and went inside.

Investigators say when she came back outside to grab her purse that she forgot outside, Weston threatened to sexually assault her.

Police spokesperson Heather Graves confirmed to FOX40 that the woman was able to call her father, who lives down the street, for help.

The woman’s father arrived to see Weston chasing the woman with a tree branch, according to Graves.

Police say Weston was able to hit the woman’s father with the branch, but only once.

The woman’s father was able to overpower Weston and hold him until police could show up, according to Graves.

Weston was booked into Stanislaus County Jail on charges of assault with a deadly weapon, making criminal threats and grand theft.
