For the first time ever, prominent Modesto defense attorney Frank Carson entered a Stanislaus County courtroom on the other side of the law.

This time, he was smiling. His wrists were in shackles, along with his wife Georgia Defilippo, California Highway Patrol Officer Walter Wells and brothers Baljit and Daljit Atwal. All five were charged with murder and ineligible for bail Tuesday,

Robert Woody was the first person of the nine to be charged. Woody is in custody in a nearby county, facing murder charges.

Once all 70 seats were occupied in the courtroom, the bailiffs shut the doors. Families and attorneys were left in the hallway.

The remaining three allegedly involved are facing lesser charges and were out on bail Tuesday; CHP officers Eduardo Quintanar and Scott McFarlane, as well as Carson’s daughter, Christina Defilippo.

A spokesperson from the Stanislaus County District Attorney’s Office said Tuesday that prosecutors on the case would decide next week as to whether or not they’ll be seeking the death penalty.
