Modesto Police Arrest Three after Shots Fired at Car

Modesto Police say they arrested three men Wednesday morning after shots were reportedly fired at a passing car.

Officers arrived at a home along Reseda Lane after a woman reported that her car was shot around 5:30 a.m. Outside the home, police contacted two men – 24-year-old Nicholas Rubalcava and 25-year-old Johnny Martinez.

Rubalcava was found to be heavily intoxicated, police say, and was taken into custody for public intoxication. Officers say Martinez ran inside the home and refused to come out.

Modesto SWAT officers were called to the scene at around 7:40 a.m., police say. Officers continued to use a loudspeaker to try to communicate to Martinez, who finally came outside just after 9 a.m.

Investigators say 23-year-old Derrick McConnell came outside with Martinez. The two were arrested without incident.

According to police, witnesses say McConnell was the main aggressor in the assault and Martinez was the gunman.

Officers found several guns inside the house. One of them was stolen, according to investigators.

Martinez was arrested for attempted homicide and McConnell was arrested for battery.
